Grandparent's Claims
Grandparent's Access
In the normal course, grandchildren benefit from contact with grandparents and extended family. Although claims for access to grandchildren are not encouraged by the courts, in rare and appropriate cases courts will order access. Generally speaking, though, a parent's decision will be respected if it is not arbitrary.
Where a positive relationship with a grandparent already exists, and it is imperilled by a parent's arbitrary decision, there may be a remedy available.
Property Claims
In appropriate cases, the parents of separating spouses may have property claims that are independent of their children, especially if funds have been advanced on condition of repayment. Such cases may give rise to an independent interest in property.
